FIELDWORKS PRO, LLC PRIVACY POLICY

This Privacy Policy explains how Fieldworks Pro, LLC ("Fieldworks Pro," "we," "us," or "our") collects, uses, discloses, protects, and retains information when you visit our website, interact with our marketing pages, communicate with us, or use the Fieldworks Pro software platform, mobile applications, and related services (collectively, the "Services").

Fieldworks Pro is a business-to-business software platform designed for commercial furniture installation, field operations, project coordination, work order management, document management, customer communication, and related field service workflows. Because our Services are used by businesses to manage employees, installers, subcontractors, customers, projects, photos, documents, floorplans, and work activity, this Policy distinguishes between information we collect for our own business purposes and information we process on behalf of our business customers.

This Policy is intended to be written in plain English. It is also intended to provide transparency for customers, employees, installers, administrators, website visitors, and other individuals whose information may be processed through the Services.

This draft is provided for business use and should be reviewed by qualified legal counsel before publication.


1. Scope of This Privacy Policy

This Privacy Policy applies to information collected through or in connection with:

  • the Fieldworks Pro website;
  • the Fieldworks Pro SaaS platform;
  • Fieldworks Pro mobile or web applications;
  • account registration, billing, support, and customer success interactions;
  • emails, forms, demo requests, sales communications, and other electronic communications with us;
  • uploaded files, documents, photos, floorplans, project records, work orders, change orders, customer records, and other content submitted through the Services;
  • marketing, analytics, and customer relationship management tools used in connection with the Services.

This Policy does not apply to websites, applications, products, or services operated by third parties that maintain their own privacy policies. If you follow a link to a third-party website or use a third-party integration, your information may be governed by that third party's privacy policy.


2. Important Terms

For clarity, the following terms are used throughout this Policy:

"Business Customer" means a company, organization, dealer, installer, subcontractor, field service provider, or other business that subscribes to or uses Fieldworks Pro.

"Customer Data" means data, files, records, communications, photos, documents, floorplans, work orders, project information, customer contacts, employee or installer records, and other content submitted to the Services by or on behalf of a Business Customer.

"End User" means an individual who accesses or uses the Services through a Business Customer account, including administrators, employees, installers, subcontractors, project managers, coordinators, or other authorized users.

"Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with an individual or household, depending on applicable law.

"Administrator" means an authorized user designated by a Business Customer to manage users, settings, projects, permissions, account access, and other administrative functions within the Services.

"Visitor" means an individual who visits our website, submits a demo request, interacts with our marketing pages, or communicates with us before creating or using a Fieldworks Pro account.


3. Our Role With Respect to Data

Fieldworks Pro may process information in different roles depending on the context.

3.1 Information We Collect for Our Own Business Purposes

When we collect information from website visitors, prospective customers, account administrators, billing contacts, or individuals who communicate directly with Fieldworks Pro, we generally use that information for our own business purposes. Examples include operating our website, responding to demo requests, providing support, processing payments, improving the Services, maintaining security, and communicating about Fieldworks Pro.

3.2 Customer Data Processed on Behalf of Business Customers

When a Business Customer uses Fieldworks Pro to upload, store, organize, manage, or process project information, work orders, employee or installer information, customer information, photos, floorplans, documents, or similar operational records, Fieldworks Pro generally processes that Customer Data on behalf of the Business Customer.

In that context, the Business Customer is responsible for determining what Customer Data is submitted to the Services, which users may access it, how long it should be retained, and whether the Business Customer has obtained any notices, consents, or permissions required by law or by its own internal policies.

Fieldworks Pro uses Customer Data to provide, maintain, secure, support, and improve the Services, and as otherwise described in this Policy or in our agreements with the applicable Business Customer.


4. Information We Collect

We collect information in the categories described below. The exact information collected depends on how you interact with Fieldworks Pro and which features are enabled by your organization.

4.1 Account and Profile Information

We may collect information needed to create, administer, and support user accounts, including:

  • name;
  • business email address;
  • phone number;
  • company name;
  • job title or role;
  • username;
  • password or authentication credentials;
  • account permissions;
  • organization, team, or project assignments;
  • administrator status;
  • user preferences;
  • support and communication preferences.

4.2 Business Customer Information

We may collect information about Business Customers, including:

  • company name;
  • business address;
  • billing contact;
  • business phone number;
  • company logo;
  • authorized administrators;
  • subscription plan;
  • account status;
  • implementation, onboarding, and support information;
  • business communications with us.

4.3 Employee, Installer, and Subcontractor Information

Business Customers may use the Services to manage employees, installers, subcontractors, project crews, or other field users. Depending on the configuration of the account, Customer Data may include:

  • name;
  • email address;
  • phone number;
  • role or trade;
  • assigned projects or work orders;
  • schedule or dispatch information;
  • jobsite assignments;
  • work notes;
  • photos uploaded from the field;
  • task completion information;
  • time, status, or activity records;
  • communications related to projects or assignments.

Business Customers are responsible for providing any required notices to their employees, installers, subcontractors, or other users regarding the use of Fieldworks Pro.

4.4 Customer Contact and Project Information

Business Customers may upload or create information related to their own customers and projects, including:

  • customer names;
  • customer business names;
  • customer addresses;
  • email addresses;
  • phone numbers;
  • jobsite addresses;
  • project details;
  • delivery, installation, or service information;
  • work orders;
  • punch lists;
  • change orders;
  • task notes;
  • schedules;
  • project status updates;
  • communications or comments related to a project.

4.5 Uploaded Files, Photos, and Documents

The Services may allow Business Customers and End Users to upload, store, or manage files and content, including:

  • photos;
  • videos, if enabled;
  • floorplans;
  • PDFs;
  • contracts;
  • proposals;
  • work orders;
  • change orders;
  • invoices or billing-related documents;
  • product information;
  • installation documents;
  • site notes;
  • customer documents;
  • other business records uploaded by users.

Uploaded content may contain Personal Information or confidential business information. Business Customers and End Users should avoid uploading sensitive information unless it is necessary for legitimate business use.

4.6 Payment and Billing Information

We use Stripe to process payments. When payments are made through the Services or in connection with a Fieldworks Pro subscription, Stripe may collect and process payment card information, billing address, transaction details, and related payment information.

Fieldworks Pro does not store complete payment card numbers on its own systems. We may receive limited payment-related information from Stripe, such as payment status, transaction identifiers, billing contact details, invoices, subscription status, and the last four digits or brand of a payment card where made available by Stripe.

4.7 Communications and Support Information

When you contact us, request a demo, submit a support request, respond to a survey, participate in onboarding, or otherwise communicate with Fieldworks Pro, we may collect:

  • name;
  • email address;
  • phone number;
  • company name;
  • message contents;
  • support tickets;
  • screenshots or attachments you provide;
  • call notes;
  • training, onboarding, and customer success records;
  • feedback about the Services.

We use Google Workspace and other business tools to manage company communications.

4.8 Website, Device, Usage, and Log Information

When you visit our website or use the Services, we may collect technical and usage information, including:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • referring URLs;
  • pages viewed;
  • links clicked;
  • date and time of access;
  • session activity;
  • login and authentication logs;
  • error logs;
  • system events;
  • feature usage;
  • approximate location derived from IP address;
  • unique identifiers from cookies or similar technologies.

This information helps us operate, secure, troubleshoot, analyze, and improve the Services.

Our public marketing website is hosted on Squarespace, and our website forms, demo requests, and marketing interactions are processed through HubSpot. These providers may collect standard technical, usage, and submission information as described in this section.

4.9 Location Information

The current version of Fieldworks Pro does not actively collect employee GPS location information.

If Fieldworks Pro introduces location-based functionality in the future, we will provide notice where required, request permissions through the user's device or browser where applicable, and use location information only for legitimate business purposes such as dispatching, jobsite verification, routing, workforce management, security, or project coordination.

If location functionality is enabled in the future, authorized administrators within a Business Customer's organization may be able to access location-related information for users associated with that Business Customer account, depending on account settings and permissions.

4.10 AI Feature Information

Fieldworks Pro may offer AI-powered features to help users summarize, search, organize, draft, classify, or analyze business information, project records, documents, work orders, communications, or similar content.

When an AI feature is used, the information submitted to or processed by that feature may include Customer Data, uploaded content, prompts, user instructions, generated outputs, and related usage logs.

Fieldworks Pro does not use Customer Data to train artificial intelligence models, and we do not permit our AI service providers to use Customer Data to train their models.

4.11 Information From Third Parties

We may receive information from third-party providers or sources, including:

  • Business Customers that create accounts for End Users;
  • administrators who invite users or assign permissions;
  • Stripe for payment and subscription status;
  • HubSpot for sales, CRM, marketing, and website interaction information;
  • Google Workspace for communications;
  • referral partners, integration partners, or service providers;
  • publicly available business contact information;
  • information you authorize third parties to share with us.

5. How We Use Information

We use information for the purposes described below.

5.1 To Provide and Operate the Services

We use information to:

  • create and manage accounts;
  • authenticate users;
  • provide software features;
  • store and organize Customer Data;
  • manage projects, work orders, schedules, documents, and photos;
  • enable administrators to manage users and permissions;
  • provide dashboards, reports, notifications, and workflows;
  • process payments and manage subscriptions;
  • provide customer support;
  • maintain and improve the Services.

5.2 To Communicate With You

We use information to:

  • respond to inquiries;
  • schedule demos;
  • send onboarding and training information;
  • provide customer support;
  • send service announcements;
  • provide account, billing, and security notices;
  • communicate about product updates;
  • send marketing communications where permitted by law.

You may opt out of marketing emails by using the unsubscribe link in the email or contacting us. Even if you opt out of marketing communications, we may still send transactional or service-related messages.

5.3 To Improve and Develop the Services

We may use information to:

  • analyze feature usage;
  • troubleshoot errors;
  • improve performance;
  • develop new features;
  • personalize user experience;
  • improve onboarding and support;
  • understand customer needs;
  • test and improve AI-assisted features;
  • create aggregated or de-identified insights.

5.4 To Maintain Security and Prevent Misuse

We use information to:

  • protect accounts;
  • detect unauthorized access;
  • prevent fraud;
  • monitor suspicious activity;
  • debug errors;
  • enforce our agreements;
  • protect the rights, safety, and security of Fieldworks Pro, our customers, users, and others.

5.5 To Comply With Legal and Business Obligations

We may use information to:

  • comply with applicable laws;
  • respond to lawful requests;
  • maintain business records;
  • resolve disputes;
  • enforce agreements;
  • process tax, accounting, billing, and audit records;
  • support corporate transactions such as financing, merger, acquisition, or sale of assets.

6. Customer Data and Business Customer Responsibilities

Business Customers control the Customer Data submitted to Fieldworks Pro. This may include information about the Business Customer's employees, installers, subcontractors, customers, jobsites, projects, documents, and business operations.

Business Customers are responsible for:

  • determining what Customer Data is submitted to the Services;
  • ensuring they have the right to collect and upload Customer Data;
  • providing required notices to employees, installers, subcontractors, customers, or other individuals;
  • obtaining any required consents or permissions;
  • managing user access and permissions;
  • keeping administrator credentials secure;
  • reviewing account activity;
  • deleting or exporting Customer Data as appropriate;
  • complying with employment, privacy, consumer protection, and other applicable laws.

Fieldworks Pro is not responsible for the privacy practices of a Business Customer with respect to its own employees, installers, subcontractors, customers, or other individuals. Individuals with questions about how a Business Customer uses their information should contact that Business Customer directly.


7. Enterprise Administrators and Account Permissions

Administrators may have access to information associated with their organization's Fieldworks Pro account, including user profiles, project records, work orders, uploaded files, photos, reports, activity information, and account settings.

Depending on permissions and configuration, administrators may be able to:

  • invite, deactivate, or remove users;
  • assign roles and permissions;
  • view project activity;
  • view uploaded documents and photos;
  • manage work orders and job assignments;
  • access reports;
  • configure account settings;
  • export or delete certain information.

End Users should understand that their use of Fieldworks Pro through a Business Customer account may be subject to that Business Customer's internal policies, employment policies, contractor agreements, or other applicable rules.


8. AI and Automated Processing

Fieldworks Pro may use artificial intelligence or machine learning features to support product functionality. These features may help users perform tasks such as:

  • summarizing notes or project activity;
  • organizing documents;
  • extracting information from uploaded files;
  • drafting communications;
  • searching project records;
  • identifying trends or missing information;
  • assisting with workflow recommendations.

AI outputs may be inaccurate, incomplete, or not appropriate for every situation. Users are responsible for reviewing AI-generated outputs before relying on them or sharing them externally.

Fieldworks Pro does not use Customer Data to train artificial intelligence models, and we do not permit our AI service providers to use Customer Data to train their models. We may use trusted AI service providers to process data on our behalf solely for the purpose of providing AI-powered features, subject to contractual obligations designed to protect confidentiality and security.

We may use de-identified, aggregated, or synthetic information to evaluate, improve, or develop features, provided that such information does not identify a specific individual or Business Customer.

Fieldworks Pro does not currently make legal, employment, credit, housing, insurance, health care, criminal justice, or similarly significant decisions about individuals using automated processing.


9. Cookies, Analytics, and Similar Technologies

We use cookies and similar technologies to operate our website and Services, remember preferences, analyze usage, support security, and improve customer experience.

9.1 Types of Cookies and Technologies We May Use

Essential Cookies. These are necessary for website and application functionality, security, login sessions, fraud prevention, and account access.

Functional Cookies. These help remember preferences and improve user experience.

Analytics Cookies. These help us understand how visitors and users interact with our website and Services, including page views, traffic sources, feature usage, and performance.

Marketing and CRM Technologies. We may use HubSpot and related tools to manage customer relationships, demo requests, website forms, marketing communications, and sales interactions.

9.2 Managing Cookies

You can control cookies through your browser settings. If you disable cookies, some parts of the website or Services may not function properly.

Where required by law, we will provide additional choices regarding non-essential cookies or similar tracking technologies.

9.3 Do Not Track

Some browsers offer a "Do Not Track" signal. Because there is not a uniform legal or technical standard for responding to these signals, we do not currently respond to browser Do Not Track signals. Where required by applicable law, we will honor legally recognized opt-out preference signals.


10. How We Disclose Information

We do not sell Personal Information for money. We disclose information only as described in this Policy, as directed by a Business Customer, as needed to provide the Services, or as permitted or required by law.

10.1 Service Providers and Vendors

We may disclose information to service providers that help us operate our business and provide the Services, including:

  • Amazon Web Services (AWS) for cloud hosting and infrastructure;
  • Stripe for payment processing and subscription billing;
  • HubSpot for customer relationship management, marketing automation, and website forms;
  • Google Workspace for business email, documents, and communications;
  • customer support, analytics, security, monitoring, and communication providers;
  • professional advisors such as attorneys, accountants, auditors, and consultants.

These providers are authorized to use information only as needed to provide services to Fieldworks Pro or as otherwise permitted by law and contract.

10.2 Business Customers and Administrators

If you use Fieldworks Pro through a Business Customer account, information associated with your use of the Services may be available to that Business Customer and its authorized administrators.

10.3 Integrations and User-Directed Disclosures

If you or your organization choose to connect Fieldworks Pro to a third-party service or direct us to share information with another party, we may disclose information as instructed.

10.4 Legal Compliance and Protection

We may disclose information when we believe it is reasonably necessary to:

  • comply with applicable law;
  • respond to subpoenas, court orders, legal process, or lawful government requests;
  • enforce our agreements;
  • protect the rights, property, or safety of Fieldworks Pro, our customers, users, or others;
  • detect, prevent, or address fraud, security, or technical issues.

10.5 Business Transfers

If Fieldworks Pro is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be disclosed or transferred as part of that transaction, subject to appropriate confidentiality and legal protections.

10.6 Aggregated or De-Identified Information

We may disclose aggregated or de-identified information that does not identify a specific individual or Business Customer for analytics, research, benchmarking, product improvement, marketing, or other lawful business purposes.


11. Sales, Sharing, and Targeted Advertising

Fieldworks Pro does not sell Personal Information for monetary consideration.

We do not currently disclose Customer Data to third parties for cross-context behavioral advertising.

Some privacy laws define "sale," "sharing," or "targeted advertising" broadly. If our use of website analytics, marketing tools, or advertising technologies is considered a sale, sharing, or targeted advertising under applicable law, we will provide required notices and opt-out mechanisms.


12. Security

We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, loss, misuse, disclosure, alteration, or destruction.

Our security measures may include, as applicable:

  • cloud infrastructure hosted on AWS;
  • encryption in transit using TLS;
  • access controls and user permissions;
  • authentication controls;
  • logging and monitoring;
  • account activity records;
  • backups and disaster recovery practices;
  • employee access limitations;
  • vendor review and contractual confidentiality obligations;
  • internal security practices and training;
  • procedures for investigating suspected security incidents.

No method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security. Users and Business Customers are responsible for maintaining the confidentiality of their login credentials, managing user access, and promptly notifying us of suspected unauthorized access.


13. Data Retention

We retain information for as long as reasonably necessary to provide the Services, maintain accounts, comply with legal obligations, resolve disputes, enforce agreements, and support legitimate business purposes.

Retention periods may vary depending on the type of information and the context in which it is processed. For example:

  • account information may be retained while an account is active;
  • Customer Data may be retained according to the Business Customer's account settings, contract, or instructions;
  • billing and transaction records may be retained as required for tax, accounting, and legal purposes;
  • support records may be retained to provide customer service and maintain business records;
  • logs and security records may be retained for security, fraud prevention, troubleshooting, and compliance;
  • backup copies may persist for a limited period before being overwritten or securely deleted.

When information is no longer needed, we may delete, de-identify, aggregate, or securely retain it as required by law or legitimate business needs.


14. Your Choices

14.1 Account Information

Users may be able to access, update, or correct certain account information through the Services. Some account changes may need to be made by an administrator or by contacting Fieldworks Pro.

14.2 Marketing Communications

You may opt out of marketing emails by using the unsubscribe link included in the email or by contacting us at info@fieldworkspro.com. We may still send transactional, account, billing, legal, or security-related messages.

14.3 Cookies

You may control cookies through your browser settings. Some features may not work properly if cookies are disabled.

14.4 Customer Data Requests

If your information was submitted to Fieldworks Pro by a Business Customer, we may direct you to that Business Customer to exercise certain rights. We will assist Business Customers with privacy requests as required by applicable law and our agreements.


15. U.S. State Privacy Rights

Depending on where you live and how you interact with Fieldworks Pro, you may have certain privacy rights under applicable U.S. state privacy laws.

These rights may include:

  • the right to confirm whether we process your Personal Information;
  • the right to access Personal Information we maintain about you;
  • the right to request correction of inaccurate Personal Information;
  • the right to request deletion of Personal Information;
  • the right to obtain a portable copy of certain Personal Information;
  • the right to opt out of the sale of Personal Information;
  • the right to opt out of sharing or processing for targeted advertising where applicable;
  • the right to opt out of certain profiling that produces legal or similarly significant effects;
  • the right to limit the use or disclosure of Sensitive Personal Information where applicable;
  • the right not to be discriminated against for exercising privacy rights;
  • the right to appeal a denied request where required by law.

Not all rights apply in all circumstances. Certain exceptions may apply, including when information is needed to provide the Services, maintain security, comply with law, complete transactions, detect fraud, exercise legal rights, or fulfill contractual obligations.

15.1 California Privacy Rights

California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. These may include the right to know, access, correct, delete, obtain a copy of, opt out of sale or sharing, limit the use of Sensitive Personal Information where applicable, and be free from discrimination for exercising privacy rights.

During the preceding 12 months, we may have collected the categories of Personal Information described in this Policy, including identifiers, commercial information, internet or network activity information, professional or employment-related information, geolocation information if enabled in the future, and content or records submitted through the Services.

We do not sell Personal Information for monetary consideration. We do not knowingly sell or share Personal Information of individuals under 16.

15.2 Other State Privacy Rights

Residents of certain other states may have rights similar to those listed above, including rights to access, correct, delete, obtain a copy of Personal Information, opt out of sale, targeted advertising, or certain profiling, and appeal a denied request.

Please include enough information for us to verify and process your request. We may need to verify your identity before responding. If your request relates to information controlled by a Business Customer, we may direct you to that Business Customer or coordinate with them as appropriate.

15.4 Authorized Agents

Where permitted by law, you may designate an authorized agent to submit a request on your behalf. We may require proof that the agent is authorized and may also require you to verify your identity directly with us.

15.5 Appeals

If we deny a request and applicable law gives you the right to appeal, you may appeal by contacting us at info@fieldworkspro.com and including "Privacy Appeal" in the subject line.


16. Sensitive Personal Information

Fieldworks Pro is not designed to collect highly sensitive personal information such as Social Security numbers, driver's license numbers, passport numbers, precise financial account credentials, medical records, biometric identifiers, race, ethnicity, religion, sexual orientation, or health information.

However, Business Customers and End Users may upload files or notes that contain sensitive information. Business Customers and End Users are responsible for ensuring that uploaded content is appropriate, lawful, and necessary for business use.

If future features collect information considered sensitive under applicable law, such as precise geolocation, we will provide notice and choices as required.


17. Children's Privacy

The Services are intended for business use by individuals who are at least 18 years old.

Fieldworks Pro does not knowingly collect Personal Information from children under 13. If we learn that we have collected Personal Information from a child under 13 without required parental consent, we will take appropriate steps to delete the information.

18. International Users

Fieldworks Pro operates in the United States. If you access or use the Services from outside the United States, your information may be transferred to, stored in, and processed in the United States or other locations where our service providers operate.

Privacy laws in the United States may differ from those in your jurisdiction. By using the Services, you understand that your information may be processed in the United States.


19. Data Breach and Security Incident Notice

If we become aware of a security incident involving Personal Information, we will investigate and provide notices as required by applicable law and contractual obligations. We may notify affected Business Customers, users, regulators, or other parties as appropriate based on the nature of the incident and applicable requirements.


20. Third-Party Websites and Services

The Services may include links to third-party websites, applications, integrations, social media platforms, or services. Fieldworks Pro is not responsible for the privacy practices of third parties. Your use of third-party services is governed by their privacy policies and terms.


21. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice by posting the updated Policy on our website, updating the "Last Updated" date, sending an email, providing in-product notice, or using other reasonable means as required by law.

Your continued use of the Services after an updated Policy becomes effective means you acknowledge the updated Policy.

Current core providers include AWS, Stripe, HubSpot, Google Workspace, and Squarespace (which hosts our public marketing website).


Appendix C: Summary of Key Privacy Commitments

Fieldworks Pro is committed to the following principles:

  • We process Customer Data to provide and support the Services.
  • Business Customers control the Customer Data they submit to Fieldworks Pro.
  • We do not sell Personal Information for money.
  • We do not use Customer Data to train AI models, and we do not permit our AI service providers to train their models on Customer Data.
  • The current version of Fieldworks Pro does not actively collect employee GPS location.
  • If location features are introduced, we will provide notice and request permissions where required.
  • We use reasonable safeguards designed to protect information.
  • We provide privacy rights mechanisms where required by law.
  • We retain information only as long as reasonably necessary for business, legal, security, and service-related purposes.
